Welcome to TreClip Studio (“TreClip,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our websites, applications, and features (collectively, the “Services”). By using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services. The Services are provided by TreClip Studio, a company organized under the laws of Delaware.
These Terms, together with our Privacy Policy and any additional policies or feature-specific terms we present within the Services (“Additional Terms”), form the entire agreement (the “Agreement”). If Additional Terms apply, they are incorporated by reference.
You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the Services. If you are under 18, you represent that your parent or legal guardian has reviewed and accepted these Terms.
If you allow a minor to use the Services, you accept these Terms and are responsible for the child’s activity.
If you use the Services on behalf of an organization, you represent that you have authority to bind that entity and that these Terms apply to it. You are responsible for safeguarding credentials and all activity under your account.
You may need an account to access certain features. Provide accurate, current information and keep it updated. Do not impersonate others or share your credentials. Some features may allow sign-in via third-party accounts; if you do, you authorize us to access permitted information from that third party per its settings. Our Privacy Policy explains how we collect, use, and disclose personal data.
You agree not to use the Services to: (i) violate laws or third-party rights (including IP, publicity, or privacy rights); (ii) submit unlawful, harmful, deceptive, harassing, or obscene material; (iii) interfere with or circumvent security, quotas, or access controls; (iv) scrape, crawl, reverse engineer, or attempt to extract source code or models; (v) train or improve competing models using outputs; (vi) impersonate others or use a person’s likeness/voice without informed written consent; (vii) distribute spam or manipulate engagement metrics; or (viii) collect personal data from children under the age of digital consent. We may monitor use and suspend or terminate accounts for suspected violations.
“Content” includes videos, audio (including music/voice), images, graphics, text (e.g., prompts, captions), branding (names, marks, logos), a person’s name, photograph, voice, or likeness, software, and other materials. Publicity rights (name, photograph, voice, likeness) are part of intellectual property rights.
“User Submissions” are anything you upload, provide, or generate through the Services (e.g., inputs, brand kits, long-form videos) and any outputs you choose to store or share. You retain ownership of your User Submissions.
You grant TreClip a worldwide, non-exclusive, royalty-free license to host, store, process, transform, transmit, and display your User Submissions as necessary to provide, maintain, secure, and improve the Services and to comply with law. If you share User Submissions with others or publicly, you also grant the rights necessary to display and distribute them to your intended audience and, for public submissions or feedback, to use them for TreClip’s marketing and product improvement. When you delete your account, we stop displaying your non-public User Submissions to others (subject to backups and legal requirements). Public submissions may remain available.
We are not obligated to host or serve Content and may remove or refuse Content at our discretion. Report suspected violations via contact.html.
TreClip and its licensors own the Services (including software, interfaces, models, templates, and documentation). Subject to this Agreement, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Services. You will not copy, modify, create derivative works, distribute, sell, lease, or reverse engineer any part of the Services except as expressly permitted.
We may add or remove features, update software, or discontinue parts of the Services. Where practical, we will provide notice of changes that materially and adversely affect you.
Some features are free; others require payment (“Paid Services”). Current plan descriptions, limits (e.g., credits/minutes/assets), and pricing are shown on our Pricing pages and may change. Taxes and carrier fees (e.g., SMS/data) are your responsibility.
Subscriptions renew automatically at the then-current rate unless canceled before renewal in your account settings. Except where required by law, fees are non-refundable and we do not provide prorated refunds.
By purchasing Paid Services, you authorize TreClip and its payment processors to charge your selected payment method for applicable fees. Maintain accurate billing information and promptly update changes. If payment fails, you remain responsible for amounts due.
Trials convert to paid plans unless canceled before the trial ends. We may modify or end promotional offers at any time.
If you believe material on the Services infringes your copyright or publicity rights, submit a notice with the required details (signature, identification of the works and material, location URLs, contact information, and good-faith statements) via contact.html. Counter-notices must include your signature, identification of removed material and prior location, a good-faith statement of mistake, and your contact information and consent to jurisdiction as required by law.
The Services may integrate or link to third-party sites, tools, or models. We do not control and are not responsible for third-party services. Your use of them may be subject to their terms and policies.
You may stop using the Services at any time and may delete your account (export your data first if you wish).
We may suspend or terminate access for any reason, including violations of this Agreement or risk to the platform. Where practical, we may provide notice.
Termination may result in deletion of Content associated with your account. Sections concerning IP, disclaimers, limitation of liability, indemnity, and dispute resolution survive termination.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES AND CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR AVAILABILITY. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRECLIP AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL; OR SUBSTITUTE GOODS OR SERVICES. OUR TOTAL LIABILITY FOR CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) $100 OR (B) THE AMOUNTS YOU PAID TO TRECLIP FOR THE SERVICES IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY.
You will defend, indemnify, and hold harmless TreClip from and against claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your User Submissions, your use of the Services, or your violation of this Agreement.
This Agreement is governed by the Federal Arbitration Act, applicable U.S. federal law, and the laws of the State of New York, without regard to conflict-of-laws rules.
You are responsible for all taxes associated with your purchases and use of the Services. This Agreement is the complete agreement between you and TreClip regarding the Services and supersedes prior understandings. No waiver is implied by our failure to enforce a provision. If any provision is unenforceable, the remainder remains in effect. “Including” means “including without limitation.”
