This Prohibited Use Policy (“Policy”) supplements the Treclipse Terms of Service (the “Terms”) and governs your access to and use of Treclipse’s AI-powered creative services (“Services”), including all inputs, uploads, and generated outputs (“Content”). Defined terms have the same meaning as in the Terms.
1. Eligibility and Capacity Requirements
- You must be at least 13 years old to use Treclipse.
- If you are under 18, you must have parental or guardian consent.
- You must have the legal capacity to enter into binding agreements and comply with all applicable laws in your jurisdiction.
2. Prohibited Content
You may not use Treclipse to input, upload, generate, or distribute any Content that:
a. Is Illegal or Infringing
- Violates laws or regulations or infringes on another’s intellectual property, privacy, or publicity rights.
- Includes copyrighted materials, brands, likenesses, or assets you do not have rights to use.
- Encourages or provides instructions for illegal activity, hacking, or fraud.
- Contains private information of others without consent.
b. Is Abusive or Harmful
- Depicts or promotes violence, hate, harassment, discrimination, or intimidation.
- Contains sexually explicit or pornographic material, including sexualized depictions of minors.
- Encourages self-harm, suicide, eating disorders, or similar behaviors.
- Targets vulnerable groups or exploits minors through mature or harmful themes.
c. Is Fraudulent or Misleading
- Impersonates another person or organization, including for deepfake or deceptive purposes.
- Fabricates medical, legal, or financial advice intended to mislead others.
- Spreads false information about elections or democratic processes.
d. Involves Regulated or Restricted Activities
- Promotes or advertises regulated goods (e.g., alcohol, tobacco, pharmaceuticals, gambling) without authorization.
- Solicits money, cryptocurrency, or NFTs from users without proper licenses or disclosures.
- Contains political campaigning, spam, or misleading promotions.
3. High-Risk and Sensitive Use Restrictions
Treclipse may not be used for critical or high-risk decision making, including:
- Medical diagnosis or treatment recommendations.
- Legal, judicial, or immigration determinations.
- Financial or credit decisions affecting individuals or institutions.
- Military, infrastructure, or emergency response systems.
- Automated decisions that determine personal rights, benefits, or employment.
Educational or artistic work in these areas is allowed only with appropriate disclaimers and safeguards.
4. Prohibited Uses of the Services
- Using Treclipse for unlawful purposes or to violate third-party rights.
- Reverse-engineering, extracting, or reproducing Treclipse models or datasets.
- Using generated Outputs to train or test competing AI systems without Treclipse’s written consent.
- Removing or altering Treclipse watermarks, copyright marks, or brand identifiers.
- Automating large-scale generations that degrade service quality or bypass usage limits.
- Reproducing, reselling, or benchmarking Treclipse to create a competing service.
- Manipulating prompts to intentionally bypass moderation or produce disallowed content.
5. Developer and Integration Responsibilities
- Implement proper safety filters, moderation, and disclaimers for your applications.
- Disclose to users that Treclipse or AI-generated content is being used.
- Monitor for misuse and take prompt corrective action.
- Ensure full compliance with this Policy and applicable law.
6. Harm Evaluation and Contextual Exceptions
Treclipse evaluates violations based on context, intent, and impact. Certain otherwise restricted content may be permitted for legitimate educational, artistic, research, or journalistic purposes, provided it includes appropriate disclaimers and does not promote harm.
7. Platform Integrity and Fair Use
- You may not use Treclipse to scrape, clone, or replicate its outputs or systems.
- You may not circumvent billing, credit systems, or API limits.
- Unfair or exploitative automated use that reduces service quality for others is prohibited.
8. Monitoring, Enforcement, and Appeals
Treclipse uses automated systems and human moderation to detect policy violations. Outcomes may include:
- Content removal or restriction;
- Account warnings, suspension, or termination;
- Permanent bans for repeat or severe violations.
To appeal a moderation decision, contact safety@treclipse.com with context and intent of use. Treclipse may reinstate access upon review.
9. Refunds for Moderated Content
If content is blocked or removed before delivery due to moderation, the associated credits or fees will be automatically refunded to your account.
10. Policy Updates
This Policy may be updated as technologies and risks evolve. Treclipse will provide reasonable notice of material changes through our website or email. Continued use of the Services after updates constitutes acceptance of the revised Policy.
